Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of Scanitix, including our website at scanitix.com, QR code generation, short link creation, analytics and related services (collectively, the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Accounts

You must provide accurate, current and complete information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, to create an account.

3. Acceptable use

You agree not to use the Service to create or share QR codes or short links that:

  • link to malware, phishing pages or content that deceives recipients;
  • infringe the intellectual property, privacy or other rights of others;
  • contain unlawful, hateful, harassing, sexually explicit or violent content where unlawful;
  • facilitate spam, unsolicited bulk messaging or fraudulent schemes;
  • interfere with or disrupt the Service, or attempt to gain unauthorized access to it.

We may remove content, throttle or suspend accounts that violate these rules, where reasonably necessary.

4. Your content

You retain ownership of the destination URLs, QR code data, branding and other materials you submit ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, process and display Your Content solely as needed to operate and provide the Service. You are solely responsible for Your Content and the destinations your QR codes and links point to.

5. Plans, billing and trials

Certain features require a paid plan. Free plans may be limited in the number of links, QR codes or other resources you may create. If you purchase a subscription, you agree to pay the fees presented at checkout, which renew automatically until cancelled unless stated otherwise. Trial periods, when offered, convert to paid subscriptions unless cancelled before the trial ends. Fees are non-refundable except where required by law.

6. Analytics data

The Service records scan and click events (such as approximate location, device type and timestamp) for the QR codes and links you create. You are responsible for complying with applicable law when distributing QR codes and links, including providing any notices or obtaining any consents required from the people who scan them.

7. Intellectual property

The Service, including its design, code, trademarks and branding, is owned by Scanitix or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Service to you. You may not copy, modify or reverse engineer the Service except as permitted by law.

8. Availability and changes

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may add, change or discontinue features, and may modify these Terms. When changes are material we will notify you by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT WHERE PROHIBITED BY LAW.

10. Limitation of liability

To the maximum extent permitted by law, Scanitix shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms or if required by law. Upon termination by you, we will make your data available for export for a reasonable period before deletion, subject to legal retention requirements.

12. Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. The courts located in Israel shall have exclusive jurisdiction over any dispute arising from these Terms, except where mandatory consumer protection law grants you the right to bring proceedings in your country of residence.
